Terms and Conditions
Article 1 – Definitions
In these terms and conditions, the following definitions apply:
Cooling-off period: The period during which the consumer can exercise the right of withdrawal.
Consumer: The natural person who is not acting for purposes related to their trade, business, craft, or profession and enters into a distance contract with the entrepreneur.
Day: Calendar day.
Ongoing transaction: A distance contract relating to a series of products and/or services, where the delivery and/or purchase obligation is spread over time.
Durable medium: Any tool that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction.
Right of withdrawal: The option for the consumer to withdraw from the distance contract within the cooling-off period.
Entrepreneur: The natural or legal person who offers products and/or services to consumers at a distance.
Distance contract: A contract concluded within a system organized by the entrepreneur for distance selling, using one or more means of distance communication.
Means of distance communication: A method that can be used to conclude a contract without the consumer and entrepreneur being physically present in the same place at the same time.
Terms and Conditions: These present Terms and Conditions of the entrepreneur.
Article 2 – Right of Withdrawal
The consumer has the right to withdraw from the contract within a cooling-off period of 30 days without giving any reason. During this period, the consumer must handle the product and packaging with care.
If the consumer exercises the right of withdrawal, they must return the product with all supplied accessories and, if reasonably possible, in its original condition, in accordance with the entrepreneur’s instructions.
Article 3 – Applicability
These terms and conditions apply to every offer made by the entrepreneur and to every distance contract and order concluded between the entrepreneur and the consumer.
Before concluding a distance contract, the text of these terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated that the terms and conditions can be viewed at the entrepreneur’s premises and will be sent free of charge upon request.
If the contract is concluded electronically, the terms and conditions may be provided electronically in such a way that they can easily be stored on a durable medium.
If specific product or service conditions also apply, the consumer may always rely on the provision that is most favorable in case of conflicting conditions.
If any provision becomes invalid, the remaining provisions will remain in force, and the invalid provision will be replaced by one that reflects the original intent as closely as possible.
Situations not covered by these terms should be assessed in the spirit of these terms.
Article 4 – The Offer
If an offer has a limited validity or is subject to conditions, this will be explicitly stated. The offer is non-binding, and the entrepreneur may modify it.
The offer contains a complete and accurate description of the products and/or services. Images used are a truthful representation, although minor deviations may occur.
All images and specifications are indicative and cannot give rise to compensation or termination of the contract.
Each offer contains sufficient information for the consumer to understand their rights and obligations, including:
- Shipping costs
- How the contract is concluded
- Whether the right of withdrawal applies
- Payment, delivery, and execution methods
- Acceptance period or price guarantee period
- Costs of communication (if applicable)
- Whether the contract is archived
- How the consumer can check and correct data
- Available languages
- Applicable codes of conduct
- Minimum duration of ongoing transactions
- Optional: sizes, colors, materials
Article 5 – The Agreement
The agreement is concluded when the consumer accepts the offer and meets the conditions.
If accepted electronically, the entrepreneur will confirm receipt. Until confirmation, the consumer may cancel the agreement.
The entrepreneur ensures secure electronic transactions and payment methods.
The entrepreneur may verify whether the consumer can meet payment obligations and may refuse or impose conditions if justified.
The entrepreneur will provide the consumer with:
- Contact details for complaints
- Information about the right of withdrawal
- Warranty information
- Contract details (if not already provided)
- Termination conditions for long-term contracts
All agreements are subject to product availability.
Article 6 – Right of Withdrawal (Detailed)
The consumer may cancel a purchase within 30 days without giving reasons.
The cooling-off period starts the day after receiving the product.
The consumer must handle the product carefully and only use it as necessary to assess it.
If withdrawing, the product must be returned in original condition if possible.
The consumer must notify the entrepreneur within 30 days and return the product within 30 days thereafter. Proof of return shipment is required.
If the consumer fails to act within these periods, the purchase becomes final.
Article 7 – Costs in Case of Withdrawal
Return shipping costs are borne by the consumer.
Any payments made will be refunded within 30 days, provided the product has been returned or proof of return is supplied.
Article 8 – Exclusion of the Right of Withdrawal
The right of withdrawal may be excluded for products:
- Custom-made according to consumer specifications
- Clearly personal in nature
- That cannot be returned
- That perish quickly
- With prices subject to financial market fluctuations
- Newspapers and magazines
- Opened media/software
- Opened hygienic products
Article 9 – Price
Prices will not increase during the validity period, except due to VAT changes.
Variable pricing may apply for products subject to market fluctuations.
Price increases within 3 months are only allowed if legally required.
All prices are subject to typographical errors.
Article 10 – Conformity and Warranty
Products must comply with the agreement and legal requirements.
Warranty does not affect legal consumer rights.
Defects must be reported within 30 days.
Warranty does not apply in cases of misuse, improper handling, or unauthorized repairs.
Article 11 – Delivery and Execution
Orders are processed with care and delivered within 30 days unless otherwise agreed.
Delays will be communicated, and the consumer may cancel the order.
If a product is unavailable, a replacement may be offered.
Risk transfers upon delivery.
Article 12 – Ongoing Transactions: Duration, Termination, and Renewal
Consumers may terminate contracts with a maximum notice period of one month.
Fixed-term contracts may not be automatically renewed except under specific conditions.
Contracts longer than one year may be terminated after one year.
Article 13 – Payment
Payments must be made within 7 business days after the cooling-off period begins.
The consumer must report payment errors immediately.
In case of non-payment, reasonable costs may be charged.
Article 14 – Complaints Procedure
Complaints must be submitted within 7 days.
They will be answered within 14 days.
If unresolved, disputes may arise under dispute resolution procedures.
Article 15 – Disputes
All agreements are governed exclusively by Dutch law, even if the consumer resides abroad.
